Lease rights

Droit au bail

In Paris, prime high-street locations are rarely vacant: they change hands through an assignment of lease rights (« cession de droit au bail »), where the outgoing tenant sells the benefit of its existing lease — the address, the terms and the legal protections attached to it — to an incoming retailer. It is the standard route to secure a store on streets such as Rue Saint-Honoré. DMC identifies these opportunities, often off-market, and manages the assignment for international brands from valuation to signing.

Key money

Pas-de-porte

Key money (« pas-de-porte ») is a one-off capital payment made to the landlord when a new commercial lease is signed, typically in exchange for a sought-after location or advantageous lease terms. It should not be confused with the price of lease rights, which is paid to the outgoing tenant. DMC helps foreign retailers assess whether the amount asked reflects genuine market value before they commit.

Commercial lease

The “bail 3-6-9”

The French commercial lease ("bail 3-6-9") runs for nine years, with the tenant — and only the tenant — free to leave at each three-year break. Tenants also enjoy strong statutory protections, including a right to lease renewal and compensation if the landlord refuses it. These rules make a Paris lease a genuine long-term asset; DMC negotiates its terms so that international retailers enter the market on solid ground.
